Introduction
These terms of service (the “Terms”) govern the use of the online business operated by DIGITAL DUDS®, which specialises in handcrafted to order products. By accessing or using the Company’s website, products or services, you (“you” or “User”) agree to be bound by these Terms and the Company’s Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not access or use the Company’s website, products or services.
1. Eligibility
To access or use the Company’s website, products or services, you must be 18 years of age or older and have the legal capacity to enter into a binding agreement. By accessing or using the Company’s website, products or services, you represent and warrant that you meet these eligibility requirements.
2. Ordering
The Company’s website allows you to place orders for handcrafted to order products. Once you have placed an order, the Company will confirm your order via email. The confirmation email will include a summary of your order, including the products you have ordered, the total cost, and the estimated delivery date. Please note that the estimated delivery date is an estimate only and may change due to factors outside of the Company’s control.
3. Payment
The Company uses a third party company, to collect payments for orders placed on the Company’s website. All payments are processed through a secure, encrypted mode to ensure the safety and security of your personal and financial information.
4. Refunds and Returns
As all products offered by the Company are handcrafted to order, the Company does accept returns and issue refunds for products that are defective or damaged, with the following terms and conditions:
- The User must contact the Company within 5 business days of receiving the product and provide a photo/video of the defect or damage.
- If the return is due to an error of the Company, we will accept responsibility for the shipping costs related to the return, and we will give the user a store credit or send a replacement product free of charge.
- If the return is not due to an error of the Company, the buyer accepts full responsibility for all shipping costs and all other restrictions already listed on the topic.
- A stocking fee of 20% of the product’s value will be deducted from the refund, as the product has been manufactured on demand and kept in stock by a third-party company.
The Company takes great care to accurately depict and describe the products offered on the website, but due to variations in monitor and device settings, the colours of the products may appear differently in person than they do on the website. Additionally, as the products are handcrafted, there may be slight variations in size and shape. The User acknowledges that these variations are inherent in the handcrafted process and are not considered defects.
By placing an order with the Company, the User acknowledges and agrees to these terms regarding the returns and refunds policy. The Company reserves the right to refuse a refund or return request if the User fails to meet these terms and conditions.
Please note that we are not responsible for any damages or losses suffered by the User as a result of the shipping process of the return or replacement product.
5. Intellectual Property
The Company’s website, products and services, including but not limited to text, graphics, logos, images, and software, are protected by copyright, trademark, and other intellectual property laws. You agree not to use any of the Company’s intellectual property for any commercial or non-commercial purpose without the Company’s prior written consent.
6. Disclaimer of Warranties
The Company’s website, products and services are provided “as is” and “as available” and the Company makes no representations or warranties of any kind, express or implied, as to the operation of the Company’s website, products or services, or the information, content, materials, or products included on the Company’s website. The Company does not warrant that the Company’s website, products or services will be uninterrupted or error-free, and the Company will not be liable for any interruptions or errors.
7. Limitation of Liability
In no event shall the Company, its affiliates, or their respective officers, directors, employees, agents, or licensors be liable for any damages, including but not limited to direct, indirect, incidental, special, punitive, or consequential damages, arising out of or in connection with the use of the Company’s website, products or services.
8. Indemnification
You agree to indemnify and hold harmless the Company, its affiliates, officers, agents, and employees from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your use of the Service or your breach of these Terms of Service. The Company shall provide notice to you of any such claim, suit, or proceeding and shall reasonably cooperate with you, at your expense, in your defense of any such claim, suit or proceeding.
9. Shipping and Delivery
The Company will ship products to the address provided by the User at the time of the order. The Company is not responsible for any errors in the shipping address provided by the User. The User is responsible for any additional shipping costs if a package is returned to the Company due to an incorrect or undeliverable address. The estimated delivery date provided by the Company is an estimate only and may change due to factors outside of the Company’s control. The Company is not responsible for any delays in delivery caused by the shipping carrier.
10. Custom Orders
The Company offers custom handcrafted to order products. Custom orders may require additional time for production and delivery. The Company will provide the User with an estimated delivery date for custom orders. The Company will begin production on a custom order within 24 hours after the User has placed the order and made the full payment for the custom order. The Company does not accept returns or issue refunds for custom orders.
11. Product Variations
As all products offered by the Company are handcrafted to order, it’s important to note that there may be variations in the final product compared to the product photos displayed on the Company’s website. This includes, but is not limited to, variations in color, size, and shape of the product. The User acknowledges and agrees that due to the nature of handcrafted products, the final product may not be an exact replica of the product displayed on the website and that these variations are to be expected.
The Company takes great care to accurately depict and describe the products offered on the website, but due to variations in monitor and device settings, the colours of the products may appear differently in person than they do on the website. Additionally, as the products are handcrafted, there may be slight variations in size and shape. The User acknowledges that these variations are inherent in the handcrafted process and are not considered defects.
In the event that the User receives a product that they believe to be significantly different from the product described on the website, they should contact the Company immediately to address their concerns. The Company will make every effort to resolve any issues to the satisfaction of the User, but cannot guarantee an exact replica of the product as displayed on the website.
By placing an order with the Company, the User acknowledges and agrees to these terms regarding the variations in the final product.
12. Changes to Terms of Service
The Company reserves the right to change these Terms of Service at any time without notice. The User is responsible for reviewing the Terms of Service periodically for any changes. The User’s continued use of the Company’s website, products or services after any changes to the Terms of Service are made constitutes acceptance of the new Terms of Service.
13. Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or related to the Company’s website, products or services shall be governed by and construed in accordance with the laws of [Governing Law], without giving effect to any principles of conflicts of law. Any dispute arising out of or related to the Company’s website, products or services shall be resolved exclusively in the courts of Italy.
